The Justice Department is investigating Michael Sherwin, the former acting U.S. attorney for Washington, D.C., for remarks he made during a “60 Minutes” interview about the Capitol riot investigations, a federal prosecutor told a judge.
Sherwin said in a CBS interview that the evidence was “trending toward” meeting the criteria for filing sedition charges against some of the rioters. He said, “I think the evidence does justify those allegations.”
His comments were considered inappropriate by some former lawyers, and Justice Department officials declined to disclose whether Sherwin requested approval before agreeing to the interview.
During a hearing on Tuesday, four people were charged with being part of the Oath Keepers.U.S. District Judge Amit Mehta said, “I’m being restrained with my use of words, surprised, to say the least, to see Mr. Sherwin sitting for an interview regarding a pending lawsuit in an ongoing criminal investigation.”
The decision of Sherwin is being investigated, according to John Crabb, the head of the criminal division for the United States Attorney’s Office in Washington.
“The Department of Justice has procedures and regulations in place that control interaction with the media, and specific rules and procedures were not followed in the case of the ’60 Minutes’ interview, as far as we can see. As a result, the case has been handed over to the Office of Professional Responsibility at the Department of Justice, “Crabb said. On Friday, Sherwin stepped down as U.S attorney to return to the office of the U.S. attorney in Miami.
